Can I sell house if my ex-wife name still on the paper?

Me and wife get divorce 5 years ago. Judge say house is mine. I want to sell now but the title company say I need her signature. She live in different country and won't answer her phone. Can I sell anyway because of judge paper?

Jamie, if she is still on the deed and or mortgage, you will need her to sign off as well regardless of what the judge has stated. Unfortunately the judge's order alone isn't enough for the title company. If her name is still on the deed, it has to be removed before you can sell. The court order establishes your right to the property, but title requires a clean chain of ownership on paper. You need a real estate attorney to take that court order back to the court and get an order that formally transfers title to you alone. That's the document that fixes the deed. Once the deed reflects sole ownership, you can sell without her involvement. This is solvable, but it requires an attorney.

If ex wife still on title, you’ll need a deed signed. If a deed was signed during the divorce, the title company may still require an affidavit. Typically these things can be handled at the US Consulate in whatever country she is now located, if title prepares what is needed.
