Once an offer is accepted and signed, it becomes a legally binding contract. A seller can only back out under certain conditions—like an unresolved contingency—or risk legal consequences. Always consult your real estate agent and closing attorney before making any moves.

There can be ways. Have your daughter contact her agent and discuss what is practical and allowable in your state. It may mean that she will have to compensate the Buyer and her Agent in some way for the change of mind.

Once both parties have signed and agreed to the terms, it becomes a bi-lateral binding contract. A seller can request to cancel, but it can’t be done unilaterally without potential legal or contractual consequences. If you’re in that position, talk with your broker immediately and seek qualified legal advice before taking action. As agents, we can guide you on how to complete state approved forms, but advising whether to cancel is a legal matter, not a sales one.

Usually not, once the counter offer is accepted by the buyer and you have an executed contract, the seller is locked in. The buyers may be willing to release the sellers of her obligation, but it can be a difficult process. As the other agent recommended contact her agent.
