Can I divide my property and sell only part of it?

We have 5 acres of land. We'd like to keep our house and sell some of the land. Is it possible to divide our current property and sell part of it? We'd like an acre but could be flexible.

It will depend on your county. You will want to contact your county building department to ask them what this process looks like and if its currently zoned appropriately for you to do so. In my area, you would have to obtain water rights for any additional parcels of land you are creating, then have a surveyor do the work to divide and and have an attorney write up the documentation needed. This is a timely and expensive process in my area and about 99% of everyone that looks into the cost and involvement decides not to move forward.

Hi Carl! Unsure of your towns restrictions, but you should be able to split your land however you like. The issue may be that it may not be buildable with frontage and other bi-laws. A local realtor should be able to point you in the right direction!

Sometimes, yes, but it usually requires zoning approval, surveys, and possible re-platting. It’s not always quick.

First, you need to make sure there are no restrictions on the deed. Where I am, when farm lands were bought out divided into parcels, they put basic HOA restrictions one of which was that all land should stay in 5 acre lots. Others had to do with how large your home had to be and things like how many out buildings you could have. If you are all clear on that, then make a visit to the city or county and just let them know your intentions & ask what you need to do. If you have a real estate attorney, they can probably take care of all the red tape for you.
