That is called an encroachment and is considered a material fact that needs to be disclosed to buyers. Also, when the buyer does a survey it becomes an issue with the title company an an existing encumbrance on the property. It would be best to have your property surveyed so you know where the legal property line is lcoated, and have your neighbor relocate their fence onto their property prior to listing your home for sale.

I always advise my buyers to visit their future neighborhood different days of the week and at different times of the day. I know this is not always possible but if you have a preferred neighborhood where you would like to purchase, start visiting that neighborhood regularly. Walk the neighborhood and just watch and listen- its amazing what you learn from just doing that!
