Answered Questions
The answer would be how was the deed actually legally recorded? If a house is built on family land then its considered real property. Is your name on the deed? If so, the property generally cannot be sold without you agreeing to it. If you paid to build your home but were never added to the actually deed..then this can be more difficult as it seems to me if they sold then you may not have the rights to the home. I would highly suggest you contact a real estate attorney for further assistance on this. This is a tough situation that you are finding yourself in. Where are you located? I may be able to assist you better..?
Yes, I would suggest replacing the roof now before you sell because not only will having a new roof add the value to the sale of your home but it will show the buyers that you have maintained the property and provide them with a peace of mind. It's better to have the paperwork and warranty information available for when you list the home. If you plan on selling your home as-is condition, then you will get a much lower price, if you are not able to do the small fixes or in this case a large investment of the roof, then you may need to sell as-is. Each situation is different for each home owner.
First of all, I am very sorry to hear this, my condolences. To answer your question, here in New York, you do not need to disclosure that someone has passed away in the property that you are selling.
Renee-I am sorry to hear of the passing of your parents. The property sounds very nice with the land but it depends on what you are looking to do. In many cases, people want a quick sale as-is and they opt for a lower (typically 30% lower) cash offer and it usually closes within a few short weeks. If you are looking to get closer to market value and you're not in a hurry then I would highly suggest you contact a local realtor that can assist you. They will understand the market and get you top dollar for the property, I have worked with both type of clients in the past, one that didn't want to return to the property, sold it as - is and basically just walked away from it and then I have had clients that after inheriting the property, they went back to clear it out and do minor repairs, then we listed it and got them $22,000 over asking price. If you need an introduction to a local Realtor to discuss this in more details just let me know as I have a great agent in Arkansas that I could introduce you to(no fee). Good Luck!
